TERMS AND CONDITIONS 

1.         All work undertaken will be discussed and agreed prior to the start date and all work will be completed from the original design by LONSDALE LANDSCAPES unless other wise agreed. 

2.         The quote/original price for work includes all materials and labour where stated from original design. 

 

2(a).    Errors and Omissions are Excepted on all quotes.

 

3.         The client will be responsible for all payments to LONSDALE LANDSCAPES, unless otherwise notified in writing prior to commencement. 

  • Payments are to be in 3 instalments, each instalment being one third of the overall cost, unless otherwise agreed at the time. Payment methods are cash or internet bank transfer.
  • First instalment is required up to 2 weeks prior to work commencing so materials can be purchased for the start date of the agreed work, normally cash unless otherwise agreed.
  • The second payment will be collected halfway through the project.
  • Final payment will be collected within 7 days when all the work is completed.
4.         Any addition and/or alterations to the schedule/project shall be properly treated as variations and subject to written instructions and additional payments may be required to cover the agreed changes.

5.         Acceptance of an agreed start date will ensure no increase in the cost of the works specified in the original quotation.

6.         The client shall provide water and electricity at no charge to LONSDALE LANDSCAPES.

7.         The client shall provide access to site during LONSDALE LANDSCAPES normal working hours and storage space for materials during the contract progress.

8.         LONSDALE LANDSCAPES is not able to accept responsibility for any damage to (or cost involved with) any underground hazards, obstructions or services not made known to us in writing or apparent on visual inspection.

9.         All, or any special conditions, of which LONSDALE LANDSCAPES has been informed are noted in the quotation.

10.       We are not able to accept responsibility for the well being and maintenance of living plant material, including turf, following practical substantial completion unless a maintenance contract is in existence.

11.       If necessary we reserve the right to substitute any plant with another of equal value and growth/habitat/colour in accordance with the specification.

12.       After practical substantial completion, we are not able to accept responsibility for any damage through the elements, including drought, winds, rain and frost to any material(s) including plants.

13.       Upon practical substantial completion the responsibility for the care and watering of all plants, lawns, etc., is handed over to the client and will require regular attention until established. Also, great care is taken to remove all weeds/roots from the site when being prepared but LONSDALE LANDSCAPES cannot accept resonsibilty for subsequent weed growth on completion of the project. 

 

14.       It is the sole responsibility of the Client to ensure we are made aware of any special/statutory Bylaws/Conditions/Permissions that may be involved.

15.       We accept no responsibility for works that have been carried out on land that is not under the ownership of the client and it is assumed that all planning laws or regulations have been applied before commencement of any works.

16.       Severe weather conditions may cause the delay of the start date, ongoing work or completion date of the contract. This will not affect the original agreed price.

17.       Delays caused by other companies on site may cause work to be rescheduled and charges may be made in certain circumstances.

18.       All materials on site remain the property of LONSDALE LANDSCAPES until payment is received in full.

19.       Maintenance is not included in the contract unless specified.

20.       We reserve the right to change these terms and conditions at any time, of which you will be notified of in writing.

21.       Any design is owned by Lonsdale Landscapes.  

 

22.       It is the clients responsibility to ensure that the site is cleared of any animal waste prior to the start of the project, for health and safety reasons. The project will be suspended until the site is clean and if delays run over the agreed time scale for the project, due to this reason, then Labour charges for the delays will be applied over and above the agreed quote.
